This website is operated by Academy for Self-Maximization®. Throughout the site, the terms “AoSM”, “we”, “us” and “our” refer to Academy for Self-Maximization®. These Terms of Service (“Terms”) govern your use of our website, apps, and other products and services (“Services”). As some of our Services may be software that is downloaded to your computer, phone, tablet, or another device, you agree that we may automatically update this software and that these Terms will apply to such updates. Please read these Terms carefully before accessing or using our Services. By using our Services, you agree to be bound by these Terms, including the policies referenced herein or related to the Services accessed/used by you.
Account Registration and Confidentiality. To access the Services, you may be required to register for an AoSM account by creating a user name and password. You agree to provide us with accurate, complete, and current registration information about yourself and you agree to update your information to keep it accurate and complete. It is your responsibility to ensure that your password remains confidential and secure. By registering, you agree that you are fully responsible for all activities that occur under your user name and password. We may assume that any communications we receive under your account have been made by you.
Unauthorized Account Use. You are responsible for notifying us at the contact details mentioned below if you become aware of any unauthorized use of or access to your account. You understand and agree that we may require you to provide information that may be used to confirm your identity and help ensure the security of your account. We will not be liable for any loss, damages, liability, expenses, or advocate’s fees that you may incur as a result of someone else using your password or account, either with or without your knowledge and/or authorization and regardless of whether you have or have not advised us of such unauthorized use.
Age Restriction. Any use or access by anyone under the age of 18 is prohibited, and certain regions and Content Offerings may have additional requirements and/or restrictions. By using our Services you represent and warrant that you are of 18 years of age or above.
License. Subject to these Terms and our policies (including any other terms applicable on particular Services), we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Services for your personal, non-commercial use, unless you obtain our written permission to otherwise use the content. You also agree that you will create, access, and/or use only one user account, unless expressly permitted by AoSM, and you will not share access to your account or access information for your account with any third party. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access.
Ownership. The Services are owned and operated by eSahyogi and contain material (including all software, design, text, editorial materials, informational text, photographs, illustrations, audio clips, video clips, artwork and other graphic materials, and names, logos, trademarks, and service marks) which are derived in whole or in part from the materials supplied by eSahyogi and its partners, as well as other sources, and are protected by the Indian intellectual property rights laws.
User Covenant. You agree to abide by all applicable copyright, trademark, or other applicable laws, as well as any notices or restrictions contained in the Services. You acknowledge that the Services have been developed, compiled, prepared, revised, selected, and arranged by eSahyogi and others through the application of methods and standards of judgment developed and applied through the expenditure of substantial time, effort and money and constitute the valuable intellectual property of eSahyogi. You agree to notify eSahyogi immediately upon becoming aware of any claim that the Services infringe upon any copyright, trademark, or other contractual, statutory, or common law rights. Any unauthorized use of any material contained on or through the Services may violate copyright laws, trademark laws, and other applicable laws.
Changes to Content Offerings. AoSM offers courses and content (“Content Offerings”) from various certified professionals (“Content Providers”). While we seek to provide world-class Content Offerings from our Content Providers, unexpected events do occur. AoSM reserves the right to cancel, interrupt, reschedule, or modify any Content Offerings, or change the point value or weight of any assignment, quiz, or other assessment, either solely, or by the Content Provider instructions. Content Offerings are subject to the Disclaimer and Limitation of Liability sections below.
Disclaimer of Student-Content Provider Relationship. Except as provided herein, nothing concerning your participation in any Content Offerings by Content Providers (a) establishes any relationship between you and any Content Provider; (b) enrolls or registers you in any Content Provider institution, or any Content Offering offered by any Content Provider Institution; or (c) entitles you to use the resources of any Content Provider Institution beyond participation in the Content Offering.
User Content. The Services may enable you to share your content, such as homework, quizzes, exams, projects, other assignments you submit, posts you make in any forums, and the like (“User Content”), with AoSM, instructors, and/or other users. You retain all intellectual property rights in and are responsible for, the User Content you create and share. User Content does not include course content or other materials made available on or placed on the AoSM platform by or on behalf of the Content Providers or their instructors using the Services or Content Offerings. As between the AoSM and Content Providers, such Course Offerings are governed by the relevant agreements in place between AoSM and Content Providers.
How We or Others May Use Content. To the extent that you provide User Content, you grant us a fully transferable, royalty-free, perpetual, sub-licensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use the User Content. This license includes granting AoSM the right to authorize Content Providers to use User Content with the registered students, or other learners independent of the Services. Nothing in these Terms shall restrict other legal rights AoSM may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms or other policies including our Code of Conduct.
Feedback. We may allow suggestions, ideas, comments, and other feedback regarding the Services (“Feedback”). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, AoSM does not waive any rights to use similar or related Feedback previously known to AoSM, developed by our employees, contractors, or obtained from other sources.
Prohibited Uses. In addition to other prohibitions as set forth in these Terms, you are prohibited from using the Services: (i) for any unlawful purpose; (ii) to solicit others to perform or participate in any unlawful acts; (iii) to violate any international, national, or state regulations, rules, laws or local ordinances; (iv) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (v) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (vi) to submit false or misleading information (vii) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other website or the internet; (viii) to collect or track the personal information of others; (ix) to spam, phish, pharm, pretext, spider, crawl, or scrape; (x) for any obscene or immoral purpose; (xi) to interfere with or circumvent the security features of the Services or any related website, other website or the internet; (xii) to sub-license, rent, sell, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Services with any third party; (xiii) modify, make derivate works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Services. We reserve the right to terminate your access and use of the Services for violating any of the prohibited uses.
We care about the security of our users. While we work to protect the security of your account and related information, we cannot guarantee that unauthorized third parties will not be able to circumvent our security measures. If you notice any indication that our security measures or the Services may be compromised, or if you notice any unauthorized use of your account, please notify us at the contact details given below.
Our Services may allow the ability to access and/or use content provided by instructors, other users, and/or other third parties and links to websites and services maintained by such third parties. AoSM cannot guarantee that such third-party content, in the Services or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any filed therein. You further acknowledge and agree that AoSM shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third party links or contents. Your interaction with such third parties will be governed by the third parties' own terms of service and privacy policies and any other similar terms.
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to service descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service or any related website is inaccurate at any time without prior notice (including after you have subscribed to or paid for the Services).
We undertake no obligation to update, amend or clarify information in the Service or any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

AoSM offers paid Services (e.g., course certificates for certain courses) for a fee. Unless otherwise stated, all fees are quoted in Indian Rupees. You are responsible for paying all fees charged by or for AoSM and applicable taxes on time with a payment mechanism associated with the applicable paid Services. If your payment method fails or your account is past due, we may collect fees using other mechanisms. Fees may vary based on your location and other factors and AoSM reserves the right to change any fees at any time at its sole discretion. Any change, update, or modification will be effective immediately upon posting through relevant Services. Under no circumstances will any refund be allowed for any applicable paid Service.
Cancellation of Subscription. In the case of subscription-based Services, you may cancel your subscription to our Services at any time before the end of the then-current billing period and the cancellation will take effect on the next billing period. Your subscription will remain active from the time you cancel until the start of the next billing period, however, you would not be entitled to any refund or credit for the remaining days in your current billing period.
Others. Once you submit your payment information on the Services interface, you agree to pay all costs that you incur and you permit us to charge you when the payment is due for an amount that includes these costs and any applicable taxes and fees.
Online Payment Mechanism. We may provide a payment mechanism on the Services interface which may utilize a third-party payments service. In case such a payment mechanism is utilized, you are authorizing recurring payments, and that payments will be made to AoSM at the recurring intervals in case of Subscription Services and at the time of purchasing certain Services, as the case may be. If your debit card, credit card, or other payment information is declined for payment of the subscription to our Services, you must provide a new payments information, or your subscription may be canceled by AoSM at its sole discretion.
Disclaimer. To the maximum extent permitted by law, the Services and all included content are provided on an “as is” basis without warranty of any kind, whether express or implied. AoSM, its affiliates, and Content Providers (“AoSM Parties”) specifically disclaim all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement and any warranties arising out of a course of dealing or usage of trade. AoSM Parties further disclaim any liability related to your access or use of the Services or any related content. You acknowledge and agree that any access to or use of the Services or such content is at your own risk.
Limitation of Liability. To the maximum extent permitted by law, AoSM Parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from (?) your access to or use of or inability to access or use the Services; (?) any conduct or content of any Party other than the applicable AoSM Party, including without limitation, any defamatory, offensive, or illegal conduct; or (?) unauthorized access, use or alteration of your content or information. In no event shall AoSM’s aggregate liability for all claims related to the Services exceed INR 1,000 or the total amount of fees received from AoSM from you for the use of the paid Services during the past six months, whichever is greater.
Your Acknowledgement. You acknowledge and agree that the disclaimers and limitations of liability outlined in these Terms reflect a reasonable and fair allocation of risk between you and the AoSM Parties and that these limitations are an essential basis for AoSM’s ability to make the Services available to you on an economically feasible basis.
You agree to indemnify, defend, and hold harmless the AoSM Parties from any claims, liabilities, expenses, and damages (to the extent attributable to you under the applicable law), including reasonable legal counsel’s fees and costs, made by any third party related to (?) your use or attempted use of the Services in violation of these Terms; (?) your violation of any law or rights of any third party; or (?) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
The obligations and liabilities of the parties incurred before the termination date shall survive the termination of this agreement for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
Except as provided below, the Services are managed by AoSM which is located in [insert location]. You agree that these Terms will be governed by the laws of India, excluding its conflict of law provisions. You and AoSM Parties agree to submit all disputes before the exclusive jurisdiction of the courts at [insert jurisdiction], India.
Revisions to these Terms. We reserve the right to reserve the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. In all cases, your continued use of the Services after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.
Entire Agreement. These Terms constitute the entire agreement between you and AoSM regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and AoSM. You may be subject to additional terms and conditions that apply when you use or access specific Services, which AoSM shall provide to you at the time of such use or access, and such additional terms and conditions shall be deemed a part of these Terms by this reference.
Promotions. We may, from time to time, include contests, promotions, sweepstakes, or other activities (“Promotions”) that require you to submit material or information concerning yourself. Please note that all Promotions may be governed by separate rules that may contain certain eligibility requirements, such as restrictions as to age and geographic location. You are responsible to read all Promotions rules to determine whether or not you are eligible to participate. If you enter any Promotion, you agree to abide by and comply with all Promotions Rules.
Severability and Waiver. If it turns out that a particular provision of these Terms is not enforceable, this will not affect any other terms. If you do not comply with these Terms, and we do not take immediate action, this does not indicate that we relinquish any rights that we may have (such as taking action in the future).
Copyright Infringement Notice. If you are a copyright owner or such owner’s agent and believe any material/ content on our Services constitutes an infringement on your copyright, please contact us setting forth the following information:
A physical or electronic signature of the copyright owner or a person authorized to act on his behalf;
Identification of the material that is claimed to be infringing;
Your contact information, including your address, telephone number, and email.
A statement by you that you have a good faith belief that the use of the material is not authorized by the copyright owners;
A statement that the information in the notification is accurate, and under penalty of perjury you are authorized to act on behalf of the owner.
Content Providers. Our Content Providers and integrated service providers are third-party beneficiaries of the Terms and may enforce those provisions of the Terms that relate to them.
Independent Parties. AoSM, Content Providers, and you are all independent parties. These Terms do not create any partnership, franchise, joint venture, agency, fiduciary, or employment relationship between the Parties.
Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our consent. AoSM shall be free to assign its rights and obligations under these Terms, to a corporate affiliate, or in connection with a merger, acquisition, corporate reorganization, or the sale of all, or substantially all, of its assets. Any purported assignment in violation of this provision is void.
Force Majeure. The AosM Parties will not be liable because of any failure or delay in the performance of its obligations on account of events beyond the reasonable control of a party, which may include denial-of-service attacks, a failure by a third-party hosting provider or utility provider, strikes, shortages, riots, fires, acts of God, war, terrorism, and government actions.
